By accessing or using any of our services (collectively, the "Services"), you agree to be bound by these Terms.

2. Eligibility and Account Registration

• Minimum Age: You must be at least 13 years old (or the minimum legal age in your country). Users under 18 must have consent from a parent or legal guardian.
• Accurate Information: When creating an account, you agree to provide truthful, current, and complete information.
• Account Security: You are responsible for keeping your login details secure. Do not share your credentials or allow others to access your account.
• Authorized Use: If you're registering or using the Services on behalf of a business or organization, you must have the legal authority to bind them to these Terms.

3. Using Linah.ai's Services

Permitted Use

You may use our Services in accordance with these Terms and applicable laws. Your use must comply with:

• Linah.ai's Usage and Content Guidelines
• All official documentation, policies, and instructions provided by Linah.ai

Restrictions

You may not:

• Use the Services for unlawful, harmful, or abusive purposes
• Infringe on intellectual property, privacy, or other rights
• Reverse engineer, decompile, or attempt to extract the source code of any Linah.ai technology
• Use automated tools to extract data or content
• Misrepresent AI-generated content as human-authored
• Interfere with our platform's operation or security
• Use output from our Services to train competing models

4. Prohibited Use Cases

Use of Linah.ai's Services for the following is strictly prohibited and may lead to immediate account termination and legal action:

• Pornographic Content
• Gambling Services
• Illegal Drug Promotion
• Fraud, Scams, or Ponzi Schemes
• Any other unlawful or unethical activity

5. Software and Updates

Some Services may include downloadable software (e.g., apps). Software may update automatically. Open-source components may be subject to their own licenses.

6. Organizational Accounts

If you sign up using a work or institutional email, your account may be linked to that organization's Linah.ai workspace. In such cases, the organization may gain administrative control over your account and its content.

7. Third-Party Services

Linah.ai may integrate with third-party services. These services are governed by their own terms, and Linah.ai is not responsible for their content or operation.

8. Your Content

• Input and Output: You may provide input ("Input") and receive AI-generated results ("Output"). Together, these are referred to as "Content".
• Your Rights: You retain ownership of your Input.
• Content Ownership: Linah.ai retains full ownership of the resulting Output. By submitting Input, you grant Linah.ai a worldwide, irrevocable, perpetual, royalty-free license to use, reproduce, modify, and create derivative works from your Input. All rights in the Output are owned by Linah.ai, and you receive no ownership rights in the Output, except where otherwise agreed in writing.
• Non-Exclusive Output: Due to the nature of AI, similar or identical Output may be provided to other users.

9. Content Usage and Model Training

We may use Content to operate, improve, and secure our Services, including model training, unless you opt out.

• Opt-Out: If you do not want your Content used for training, you can opt out via your account settings or by contacting us.

10. Accuracy and Responsibility

AI is a probabilistic system and may generate inaccurate or inappropriate content. You agree:

• Not to rely on Output as a sole source of truth
• To review and verify all Output before use
• Not to use Output for decisions that significantly impact people (e.g., hiring, healthcare, finance)

11. Intellectual Property

Linah.ai owns all rights, title, and interest in the Services, including software, models, and trademarks. Use of our name, logo, or brand must comply with our Brand Guidelines.

12. Payment and Subscriptions

• Billing: Accurate payment information is required for paid Services. Subscriptions renew automatically unless canceled.
• Service Credits: Prepaid service credits are subject to separate terms.
• Refunds: Payments are non-refundable unless required by law.
• Price Changes: We'll provide at least 30 days' notice before subscription price increases take effect.

13. Termination

We may suspend or terminate your account if:

• You violate these Terms or applicable laws
• Your use poses a risk to Linah.ai or others
• Your account has been inactive for over 12 months (if unpaid)

Appeals can be submitted to our Support team.

14. Ending the Service

If Linah.ai discontinues any Service, we'll give you advance notice and refund any unused prepaid amounts.

15. Disclaimers

All Services are provided "as is." Linah.ai disclaims all warranties, including:

• Implied warranties of merchantability or fitness
• Accuracy or availability
• Freedom from errors or security issues

Use Output at your own risk and discretion.

16. Limitation of Liability

To the fullest extent permitted by law, Linah.ai is not liable for:

• Indirect, incidental, or consequential damages
• Lost profits or data
• Any claim exceeding the greater of $100 or the amount you paid in the prior 12 months

Some jurisdictions may not allow certain limitations, in which case these may not fully apply to you.

17. Indemnification

If you're a business or organization, you agree to indemnify and hold harmless Linah.ai and its affiliates from any claims or liabilities arising from your use of the Services or your Content.

18. Dispute Resolution

Binding Arbitration & Class Action Waiver

• Arbitration: You and Linah.ai agree to resolve disputes through binding arbitration, not court.
• Opt-Out: You may opt out within 30 days of account creation or any arbitration updates.
• Informal Resolution First: Contact us to try resolving disputes informally before filing arbitration.
• No Class Actions: All disputes must be handled individually. Class, collective, or representative actions are not permitted.

Exceptions

• Small claims court cases
• Injunctions for unauthorized use or IP infringement

19. Copyright Infringement

If you believe your intellectual property has been infringed, notify us at info@linah.ai or via our copyright form with:

• Your contact info and signature
• Description of the infringed work
• Location of infringing material
• Good-faith statement and declaration of ownership

20. General Terms

• Assignment: You may not transfer your rights under these Terms. We may assign ours.
• Changes: We may update these Terms or our Services as needed.
• Severability: If a provision is found invalid, the rest of the Terms still apply.
• Trade Compliance: You agree to comply with all applicable export and sanctions laws.
• Entire Agreement: These Terms form the full agreement between you and Linah.ai.

21. Governing Law

These Terms are governed by the laws of the State of New South Wales, excluding its conflict of laws rules. All claims will be resolved in Sydney, New South Wales, unless otherwise required by arbitration.
